Customer acknowledges and understands that performance tuning, dyno tuning, forced induction systems, fuel system upgrades, drivetrain modifications, engine modifications, aftermarket parts, and other performance-related upgrades may increase stress on the engine, transmission, driveline, fuel system, cooling system, electrical system, emissions components, and other vehicle components.
Customer understands that modifying a vehicle from its original manufacturer configuration may result in reduced reliability, increased wear, drivability changes, emissions compliance concerns, warranty denial, part failure, engine failure, transmission failure, drivetrain failure, or other mechanical or electrical issues. These risks may exist regardless of the quality of parts used, workmanship performed, or tuning provided.
KAP Motorsports does not guarantee that any modified or tuned vehicle will remain free from mechanical failure, part failure, drivability issues, or damage. Customer agrees that KAP Motorsports shall not be held liable for any damages, failures, losses, costs, repairs, towing, storage, loss of use, diminished value, warranty denial, or incidental or consequential damages arising from or related to performance tuning, aftermarket upgrades, vehicle operation, racing, abuse, pre-existing conditions, customer-supplied parts, manufacturer defects, improper maintenance, fuel quality, or use of the vehicle after modification.
Customer acknowledges that all performance modifications and tuning are performed at the customer’s request and at the customer’s own risk. Customer is solely responsible for maintaining the vehicle, monitoring vehicle operation, using appropriate fuel, following recommended service intervals, and immediately ceasing operation if abnormal noises, warning lights, leaks, overheating, drivability issues, or other concerns occur.
By purchasing and installing parts, packages or tuning from KAP Motorsports, customer releases and holds harmless KAP Motorsports, its owners, employees, agents, and affiliates from any and all liability related to vehicle damage, component failure, mechanical failure, warranty denial, or other losses resulting from or associated with tuning, aftermarket parts, or performance modifications.
